Surf Lagoon Participation and Terms of Use – SRF PARK TLV

These terms are written in the masculine form for convenience only and apply to all genders. My participation in surfing activities in the lagoon at SRF PARK TLV (the "Activity", the "Facility" and the "Park"), operated by Yesh Galim Tel Aviv Ltd. (the "Company"), is subject to my acceptance of these Terms of Use and my agreement to all the terms set out in this document and to the safety instructions applicable at the Park.

If you are under the age of 18, you are required to read these Terms of Use together with your parent or legal guardian, who must approve and accept these terms on your behalf.

If I book an event or activity in which minors participate in surfing activities in the lagoon, I declare that I accept this document as an authorized representative of the parents of the participating minors under the age of 18, and that their parents have provided me with signed authorization to do so after reviewing these Terms of Use and the safety instructions. I undertake to ensure that the names of all minors participating in the activity are included and that their parents have signed the authorization form provided by the Park management. I declare that I have reviewed the names of the participating minors, that I know them, and that I acknowledge my responsibility as the authorized representative of their parents for accepting these Terms of Use on their behalf. I further acknowledge my responsibility in the event that a minor participates in an activity at the Park without parental approval.

This document, once accepted electronically, will apply to all activities at the Park without a time limit. The Company may, at its discretion, require these Terms of Use to be accepted again from time to time.

I acknowledge that these Terms of Use have been made available to me. If any part of these terms is unclear, I may contact the Company for further explanation. I undertake not to begin the Activity until all of these Terms of Use are clear and understood by me.

I undertake to comply with the Company's safety rules and instructions as updated from time to time, including safety briefings, safety videos, signage at the Park and instructions given by the staff at any time. I understand that the Park staff may stop the participation of any surfer who does not comply with the safety instructions.

Before each session, I undertake to complete the required safety briefing. I must arrive at the Park 30 minutes before the start of the session for the briefing and preparation. In the event of late arrival or failure to attend the briefing, the Company may prevent me from participating in the session, and the session will be considered used with no refund or credit available.

I understand that during a surf session I must wear the surf lycra provided to me at the Park, which is used to assist in managing and monitoring activity in the lagoon. The lycra may not be removed until the Activity has ended and I have exited the water. I understand that the Company may prevent surfers who do not wear the lycra as required from participating in the session or entering the lagoon.

I understand that surfing under the influence of drugs and/or alcohol and/or sedative medication or other medication that may impair my ability to function is strictly prohibited and may endanger me and those around me.

Use of the Park facilities is subject to completing a medical questionnaire and signing a health declaration or, alternatively, providing a medical certificate, as required by law. Full responsibility for obtaining and providing any required medical certificate rests with the participant and at their own expense. Without a completed medical questionnaire and signed health declaration or an appropriate medical certificate, the participant will not be permitted to participate in activities at the Park, without prejudice to the obligation to pay for the service purchased.

I fully understand that the Activity in which I wish to participate involves risks, including, without limitation, slipping, falling, injury, objects or people falling onto others, equipment failure, drowning, inability to receive immediate medical treatment or first aid, and similar risks. By participating in the Activity, I voluntarily assume these risks.

I also understand that participation in the Activity requires the continuous exercise of judgment by me and by other participants, and that one of the risks associated with the Activity is an error in judgment by any participant, including experienced surfers. I declare that while participating in the Activity I will be responsible for my personal safety and will do my best to protect myself and other participants.

I understand and acknowledge that exposure to these risks may result in serious bodily injury or death, as well as property damage, financial loss and other damage to me and those dependent on me.

I understand that the Company's insurance policies may not necessarily cover all damages to which I may be exposed as a result of participating in the Activity.

I declare that if, despite voluntarily assuming all of the risks described above, I have any claim or allegation against the Company, its directors, employees or anyone acting on its behalf or assisting it in connection with the Activity (the "Organizers") for any damage caused to me as a result of or in connection with my participation in the Activity, and if a competent court determines that the Organizers bear any liability toward me, I will have no claim or demand in respect of any damage that is not covered by the insurance policies maintained by the Company or that exceeds the limits of liability specified in such policies.

I accept the risks, whether known or unknown, of injury, loss or damage that may occur at the Park, in the lagoon or at the Facility. I expose myself to such risks with a clear understanding of their existence, with knowledge of my right to protect myself from them, and through my voluntary choice to participate in surfing activities in the lagoon despite those risks.

I understand and agree that my participation in the Activity is at my own risk and that surfing is a challenging extreme sport involving inherent risks that cannot be completely eliminated without affecting the nature of the Activity, including the risk of serious bodily injury, disability and death, whether or not I use the facilities in accordance with the safety rules. I understand that I may also be injured as a result of another person's use of the Park facilities.

I declare that I am not aware of any medical condition that prevents me from participating in the Activity and that I am legally competent to accept this declaration.

I declare that I am a competent swimmer and am able to exit the water safely.

I understand that after falling into the water, I must remain in the whitewater area and move toward the nearest shore as quickly as possible while remaining aware of other surfers in the water. I understand that after falling I must not paddle toward the open face of the wave and must avoid approaching another surfer.

I understand that I must attach the surfboard to my leg using a leash and must not remove it during the session. I also understand that surfing without a leash puts both me and the surfers around me at risk.

I understand that I must not approach other surfers while surfing. Surfing in the lagoon operates according to a designated turn order. I will paddle for a wave only when it is my turn and will not interfere with other surfers. After falling from a wave, I will follow the applicable safety instructions and staff directions.

I understand that I must paddle back to the Reef only alongside the center wall and in a manner that does not endanger surfers riding the wave, as explained in the safety video and on the safety signage. I understand that failure to do so may expose me and others to injury, including cuts, bruises, fractures, joint injuries, shoulder dislocation, injuries to the arms, legs, ankles, back, head and neck, injuries resulting from a fall or contact with another surfer, spinal injury and/or death.

I understand that if the waves stop, I must immediately follow the staff's instructions, including instructions to exit the water or wait. It is strictly prohibited to attempt to resume surfing from the point where I stopped. I understand that failure to comply with this requirement may expose me to injury, including cuts, bruises, fractures, wrist injuries, shoulder dislocation, injuries to the arms, legs, ankles, back, head and neck, injuries resulting from a fall or contact with another surfer, spinal injury and/or death.

I understand that after falling into the water I must pay attention to the surface beneath my feet in order to avoid injuries and cuts from objects that may be present in the water. I understand that the Park management makes efforts to keep the lagoon and its surroundings clean, but cannot guarantee that such objects will not be present in the water, and I acknowledge the risk of injury and cuts from such objects. I also understand that bees and/or other insects may be present around the lagoon and that I may therefore be exposed to insect stings. I declare that I do not have any allergies and that I understand the risks associated with insect stings.

I understand that the Company strives to provide the best possible surfing experience, but in the event of a technical issue with the lagoon facility, it may restrict or suspend the Activity in order to resolve the issue as quickly as possible.

I understand that if I choose to stop participating before the end of the session I purchased, I will not be entitled to any refund.

If the Company stops the session for any reason for a period exceeding 15 minutes, I will not be charged for the session.
